Terms and Conditions
Summary: This Terms and Conditions agreement governs rentals from Max Rentals LLC. A non-refundable deposit and an authorized signature reserve services and date. The balance is due 24 hours before the event. These terms set conduct rules, cancellation and rain policies, liability, equipment care, delivery, and legal provisions. Read carefully.
Contract and Terms
This signed Agreement, together with the signed Instruction Manual and Reservation Form, is a legal and binding contract. A non-refundable deposit and an authorized signature on your proposal will reserve your activities and date. The balance is due 24 hours before the event prior to set-up. Max Rentals reserves the right to set rules of conduct, age/weight/time limits, and safety measures.
Cancellation and Rain Policy
- Cancel or reschedule with at least 3 days' notice.
- Cancellation with less than 48 hours' notice forfeits the entire deposit.
- Cancellation after set-up begins forfeits any refund.
- Postponement with at least 24 hr notice may allow deposit credit toward a rescheduled event, subject to availability.
- Max Rentals may cancel for severe weather (thunderstorms, hail, winds >15 mph, tropical systems) and will refund deposits in full.
- If Lessee fails to notify Max Rentals of severe conditions within 24 hours of delivery, Max Rentals may refuse refunds.
- Cancellation upon delivery incurs a minimum fee of $75.00 and forfeits deposits. Return requests after cancellation add a minimum $75.00 delivery fee plus any original delivery charges.
- Full payment is due 24 hours before scheduled event.
Hold Harmless & Indemnification
Lessee acknowledges risks associated with equipment use. Lessee agrees to indemnify and hold Max Rentals harmless from all claims, costs, expenses, damages, and liabilities, including attorney’s fees, arising from injury, damage, or death connected to delivery, possession, use, operation, or return of equipment. Lessor is not liable for acts of God or conditions beyond its control. Lessee agrees to indemnify for loss, theft, or destruction of equipment during the rental term.
General Rules — Safety First
- A responsible ADULT must supervise and operate at all times.
- No participants without ADULT supervision.
- No playing on steps or front aprons.
- Remove shoes, jewelry, eyeglasses, combs, and hard objects.
- No food, drink, gum, candy, silly string, confetti, paint, make-up, pets, or solvents.
- No flips, wrestling, running, pushing, climbing net walls, or aggressive behavior.
- Only compatible age and size groups together. Mixing sizes increases injury risk.
- No sitting or laying down while others bounce.
- No water hoses unless unit is water-compatible.
- If winds exceed 15 mph, lightning occurs, or rain starts: turn motor off after participants exit, unplug, dry unit before re-inflation.
- If blower stops, evacuate calmly; common causes include overloaded circuits or debris. Use a dedicated circuit.
- In an emergency contact (470) 957-3440 and dial 911 for emergency services.
Delivery, Care & Equipment Requirements
Lessee grants Max Rentals the right to enter the property for delivery and return. Lessee is responsible for equipment until relinquished to a Max Rentals representative. Do not move, fold, store, or remove equipment. Lessee is responsible for damage beyond ordinary wear and tear. Cleaning fee: $75.00 minimum. Repair rate: $150.00 per hour plus parts and shipping. Silly String damage incurs substantial cleaning or replacement charges.
Electrical: Lessee must provide a 115V outlet with a Slo-Blo 20 or 30 amp fuse within 100 feet. Max Rentals supplies power cords to 50ft. Use only one blower per circuit. Extension cords beyond 100ft are not recommended.
The Lessee (Customer) is solely responsible for ensuring that the setup site is suitable, safe, and free of any obstructions that would prevent proper staking or installation of inflatable units, tents, or other rental equipment. The site must be a level, utility-free area that allows for secure anchoring.
The Lessee is required to contact 811 (“Call Before You Dig”) prior to delivery to have all underground public utility lines marked. This service is provided at no cost to the Lessee. If the Lessee does not have utility lines marked, Max Rentals reserves the right to set up equipment in the designated area at the Lessee’s sole risk.
Max Rentals shall not be held liable for damage to underground utilities, sprinkler systems, septic systems, or any other concealed services or property where equipment is placed. Responsibility for damages, delays, or costs resulting from unmarked or improperly marked utilities rests entirely with the Lessee.
Warranty, Insurance & Legal Provisions
- Limited warranty: equipment delivered in good working order. Lessor’s sole remedy is repair or replacement.
- Lessee must have homeowner’s, tenant, or other liability insurance. Lessee waives insurer subrogation rights against Max Rentals.
- Lessee must comply with all laws, permits, licenses, and fees.
- Prevailing party in legal actions may recover attorney’s fees and costs.
- If any provision is unenforceable, remaining terms remain effective.
Intellectual Property & Responsibilities
All designs, names, logos, trademarks, and related materials are proprietary to Max Rentals LLC.
Responsibilities — Lessor & Lessee
- Lessor will: provide power cords up to 50ft, deliver, set up, teardown, operate activities, and carry liability insurance.
- Lessee will: provide required 110V/20amp circuits and heavier gauge cords for over 50ft, supply any entrance or parking passes, and provide a minimum of 1 adult volunteer to operate activities.
By signing, Lessee acknowledges understanding, acceptance, and personal binding to these terms.
Damage Waiver Terms & Conditions
By selecting the Damage Waiver, the Customer agrees to pay a non-refundable fee equal to 10% of the total rental cost. This waiver relieves the Customer of liability for accidental damage to rental equipment, including inflatables, tents, tables, chairs, games, concession equipment, and other rental items, subject to the terms and exclusions outlined below.
What the Damage Waiver Covers
The Damage Waiver covers accidental damage that occurs during normal and intended use of the equipment by participants. Examples may include minor accidental damage that occurs despite reasonable care being exercised and that is not the result of negligence, misuse, prohibited items, theft, weather, or any excluded condition listed below.
What the Damage Waiver Does Not Cover
The Damage Waiver does not cover loss or damage resulting from:

Theft, disappearance, or failure to return equipment

Intentional damage, abuse, misuse, neglect, or vandalism

Damage resulting from moving, relocating, dragging, or repositioning equipment after setup by Max Rentals staff

Exceeding occupancy or weight limits

Failure to follow posted safety rules or instructions

Damage caused by animals, pets, or livestock
-
Damage caused by fire, smoke, fireworks, grills, candles, or open flames
-
Damage caused by severe weather, flooding, wind, standing water, or other environmental conditions
-
Unauthorized alterations, attachments, repairs, or modifications
-
Damage caused by sharp objects, shoes, jewelry, eyeglasses, toys, sports equipment, or other hazardous items
-
Excessive cleaning required beyond normal use
Prohibited Items – Inflatables
Food, drinks, candy, gum, slime, face paint, glitter, confetti, silly string, sand, dirt, rocks, mulch, sharp objects, and any foreign substances are strictly prohibited inside or on inflatables.
These materials can cause permanent staining, clog blower systems, damage seams and vinyl surfaces, create sanitation concerns, and in some cases require complete replacement of the inflatable.
Any damage resulting from prohibited items is specifically excluded from the Damage Waiver and will be charged to the Customer, including cleaning fees, repair costs, loss of rental income, and, when necessary, the full replacement cost of the equipment.
Customer Responsibilities
The Customer remains fully responsible for:

Missing, stolen, abandoned, or unreturned equipment

Damage resulting from any excluded condition listed above

Providing and maintaining a safe and suitable setup area

Supervising participants and ensuring equipment is used safely

Protecting equipment from weather, unauthorized users, and hazardous conditions

Promptly reporting any damage or malfunction to Max Rentals
Max Rentals reserves the sole right to determine whether damage qualifies for coverage under this Damage Waiver. Any damage determined to be outside the scope of this waiver shall remain the financial responsibility of the Customer.
If the Damage Waiver is not selected, the Customer assumes full responsibility for any loss, theft, damage, cleaning, repair, or replacement costs associated with the rented equipment, up to and including the full replacement value of the equipment.
Required & Optional Coverage
Residential customers may elect to purchase the optional Damage Waiver for added protection against accidental damage during normal use; however, the waiver is required for all community, school, church, corporate, and public events.
